1. Introduction

Welcome to Timevise Marketing (the "Service"), operated by InokWorkz ("we", "us", or "our").

2. Service Description

Timevise Marketing is a web application that leverages artificial intelligence to assist users in generating blog post ideas and drafting content. The Service aims to streamline the content creation process.

3. Acceptance of Terms

By creating an account, accessing, or using any part of the Service, you signify your unreserved acceptance of these Terms. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and representing that you have the authority to bind that organization to these Terms.

4. User Accounts

  1. You must be at least 13 years old to use the Service.
  2. You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
  3. We reserve the right to suspend or terminate your account at our sole discretion if you violate these Terms, or for any other reason, without prior notice or liability.

5. Acceptable Use Policy (User-Generated Content)

You are solely responsible for all content, ideas, prompts, text, images, and any other materials that you submit, input, upload, generate, or otherwise make available through the Service ("User Content").

a. Prohibited Content: You agree not to use the Service to generate, submit, or distribute any User Content that:

  1. Is illegal, promotes illegal activities, or is in furtherance of illegal activities.
  2. Is hateful, discriminatory, harassing, or promotes violence or harm against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
  3. Constitutes harassment, bullying, or threats against any person.
  4. Is sexually explicit, obscene, pornographic, or exploits or abuses children.
  5. Promotes self-harm or suicide.
  6. Is defamatory, libelous, or invades the privacy of others.
  7. Infringes upon any patent, trademark, trade secret, copyright, or other intellectual property rights of any party.
  8. Contains viruses, malware, or any other malicious code.
  9. Impersonates any person or entity, or falsely states or otherwise misrepresents your affiliation with a person or entity.
  10. Constitutes spam, phishing, or other deceptive practices.
  11. Attempts to bypass, disable, or otherwise interfere with any security-related features of the Service or the underlying AI models.

b. Content Moderation:

  1. We employ automated and manual content moderation systems to detect and prevent the generation or submission of prohibited content.
  2. All user prompts and generated content are subject to these moderation checks. Content found to violate our policies may be blocked, edited, removed, or may result in actions being taken against your account.
  3. You understand that our moderation systems may flag content for review even if it does not ultimately violate our policies. Similarly, some harmful content may occasionally evade our filters.
  4. We reserve the right, but not the obligation, to monitor User Content and to remove or disable access to any User Content at any time and for any reason, without notice.

c. Strike System for Violations:

  1. For violations of this Acceptable Use Policy, we operate a "strike" system.
  2. Each instance of submitting or attempting to generate prohibited content may result in one strike being applied to your account.
  3. Upon receiving three (3) strikes, your account will be permanently banned from using the Service.
  4. Severe Violations: Notwithstanding the strike system, we reserve the right to immediately and permanently ban your account, without warning or prior strikes, for severe violations including, but not limited to, content related to child exploitation, incitement to severe violence, or illegal activities. Such violations may also be reported to relevant law enforcement authorities.
  5. You will be notified of any strikes applied to your account and the reason for the strike. You may have the right to appeal a strike within a specific timeframe as outlined in our moderation guidelines.

6. Intellectual Property Rights

  1. Your Content: You retain all intellectual property rights in and to the original User Content that you input into the Service. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, distribute, and display such User Content for the purpose of operating, improving, and providing the Service.
  2. AI-Generated Content: The intellectual property rights concerning content generated by the AI are complex and may depend on the specific jurisdiction and the underlying AI model's terms. While we aim for you to own the output you create, we cannot guarantee ownership or the ability to obtain copyright registration for AI-generated content. You agree that any output generated by the Service is provided "as is" and you are responsible for verifying its originality, accuracy, and legality before use.
  3. Service IP: All rights, title, and interest in and to the Service (excluding User Content), including all software, code, algorithms, visual interfaces, interactive elements, design, compilation, and all intellectual property rights therein, are and will remain the exclusive property of InokWorkz and its licensors.

7. Data Privacy

Your use of the Service is also governed by our Privacy Policy, which details how we collect, use, and protect your personal data. By using the Service, you consent to the data practices described in our Privacy Policy.

8. Third-Party Services

The Service may utilize third-party APIs (such as Google's Gemini API and OpenAI's API) and services to function. You acknowledge that your use of the Service is subject to the terms and conditions of these third-party providers. We are not responsible for the practices of third-party services.

9. Disclaimers and Limitation of Liability

  1. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
  2. We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the server that makes it available are free of viruses or other harmful components.
  3. To the fullest extent permitted by law, in no event shall Timevise Marketing, its affiliates, directors, employees, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service.

10. Indemnification

You agree to defend, indemnify, and hold harmless Timevise Marketing, its affiliates, licensors, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your User Content.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

12. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Hungary, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Budapest for the resolution of any disputes.
